1. Platform Role
HAITIENInvest is a facilitation and aggregation platform only, connecting investors with offerings presented through the platform. HAITIENInvest does not endorse, verify, or adopt any opinions, viewpoints, statements, or representations expressed by any issuer, investor, or institution on this platform, and is not a party to any investment agreement, transaction, or communication between users.
2. Limitation of Liability
By using this platform, you agree to release HAITIENInvest, H.A.I.T.I.E.N. LTD., and their owners, officers, employees, directors, successors, and assigns from any and all liability, claims, or damages arising from or related to your use of this platform, including the conduct, statements, or actions of any issuer, investor, or institution.
3. Binding Arbitration; Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of HAITIENInvest shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court for disputes within that court's jurisdiction. The arbitration shall be conducted in North Carolina, and judgment on the arbitration award may be entered in any court having jurisdiction.
You and HAITIENInvest each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action. All claims must be brought in an individual capacity only.
This arbitration agreement is governed by the Federal Arbitration Act. Nothing in this clause waives any rights or remedies available under the federal securities laws that cannot be waived as a matter of law. If any part of this clause is found unenforceable, the remainder shall remain in full force and effect.
